Terms of service

These terms are a contract between you and POG Snap (“POG Snap”, “we”, “us”). You accept them by opening an account, or by using the editor without one. If you are accepting on behalf of a company, you are telling us you are allowed to bind it, and “you” means that company.

Some sections open with a plain-English line marked “In short”. Those are there to be read, not to be argued from. Where a summary and the section it sits above differ, the section governs.

Software for building a shelf set that is accurate to the inch from artwork you already have, and for getting it out again as a deck, a print sheet, a CSV space plan or a render.

It is a tool you operate. It is not a service where we build the planogram for you, and nothing it produces is advice about what to sell, where to sell it, or what a retailer will accept.

• Give a real email address and keep your credentials to yourself. What happens under your account is your responsibility.
• An organization can have several members. Anyone you invite into one can see and change that organization’s work — its SKUs, its planograms, its imported sales figures. Invite accordingly.
• Do not share a single login between people. Invite them instead; it costs nothing.
• If you think an account has been taken over, tell us at support@pogsnap.com as soon as you can.

In shortYou own your artwork, your dimensions, your planograms and your sales data. We get only the permission needed to run the service for you.

Nothing in these terms transfers ownership of anything you upload or create. You give us a limited license to host, copy, transmit, process and display it for one purpose: running the service for you and the rest of your organization. That includes sending a file to the provider that reads it when you use one of the features described in the privacy policy.

The license ends when you delete the content or close the account, except for copies sitting in routine backups until those age out.

You are telling us you have the right to upload what you upload. Packaging artwork is somebody’s copyright, and a good deal of it is covered by a brand’s own confidentiality terms. Whether a particular file may be put into a tool like this one is between you and whoever owns it.

We do not train models on your content, and we will not use your brands, your artwork or your layouts as marketing material without asking you first.

• Upload anything you do not have the rights to.
• Use it to infringe someone’s intellectual property, or to do anything unlawful.
• Try to reach another organization’s data, or probe, scrape, overload or reverse-engineer the service.
• Resell it, rent it or white-label it without our written permission.
• Use the AI features to produce anything illegal or deceptive — including passing a generated render off as a photograph of a shelf that exists, in order to mislead someone.
• Upload malware, or personal data you have no basis to be holding.

We can suspend or close an account doing any of this.

In shortThe layout is only as true as the dimensions it was given, and a photoreal render is an illustration rather than a photograph. Check both before you build, print or present.

This product exists to make a claim a buyer will believe, which makes it worth being exact about where that claim comes from.

• The dimensions come from you. A layout is accurate to what the tool was told. If a SKU is a quarter inch taller in real life than in your sheet, every planogram containing it is wrong by that much, and nothing in the software can know.
• A planogram from this tool is a proposal. Before anyone cuts steel, prints a shelf strip or commits to a modular, check it against the real fixture and against the retailer’s own space plan.
• A photoreal render is generated, not photographed. It is built from your layout, but the image model can change things it was not asked to change — in testing it turned a tan melamine bay into oak. That is why the app shows you the result before it can be saved. Look at it, and do not present it as a photograph.
• Exports are yours to check. A retailer’s planogram system may have requirements we do not know about, and a CSV that loads cleanly here is not a promise that it loads cleanly there.

What you put in front of your customer is your responsibility. We have built the tool to be checkable at every step, and the checking is yours.

Model output is generated rather than looked up. It can be wrong, and these features are built on that assumption: each returns a position or a proposal that a person confirms, never a dimension the tool then treats as fact. Do not design that person out of your process.

In shortIt is free right now. That is a fact about today, not a promise about next year.

There is no charge for POG Snap at this stage and no billing in the product at all. We can change that. If we introduce a price, we will tell you before it applies to your account, and you will have the chance to export your work and walk away instead of paying.

We try to keep it running and we do not promise that it will be. There is no uptime commitment and no service level agreement. Features can change or be withdrawn, and maintenance may happen without notice, though we will avoid US business hours where we can.

Keep your own copies of anything you cannot afford to lose. That is what the exports are for.

• You can stop whenever you like. Write to support@pogsnap.com and we will close the account and delete its data on the timetable in the privacy policy.
• We can suspend or close an account that breaks these terms, or that is being used in a way that threatens the service or other customers. Where it is reasonable to do so, we will warn you first and give you a chance to export.
• If we discontinue POG Snap altogether, we will give you at least 30 days’ notice and a way to get your work out.
• The sections that ought to outlive the account do: the backup part of the content license, our intellectual property, the disclaimers, the liability cap, the indemnity and the governing law.

The software, the site, the name POG Snap, the wordmark and the interface designs are ours. These terms give you permission to use the service and nothing more. Do not copy the interface or the branding.

If you send us an idea for the product, we can use it without owing you anything for it.

The service is provided “as is” and “as available”, without warranty of any kind, express or implied. That includes the implied warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that output is accurate, complete, or suitable for a particular product, fixture, retailer or presentation.

Some states do not allow certain warranties to be excluded, so parts of this may not apply to you.

In shortIf the tool costs you a deal, we are not liable for the deal. Our total exposure is capped at 100 US dollars while the service is free.

To the fullest extent the law allows, POG Snap is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost data, lost business or the cost of substitute services — including a shelf set that turned out to be wrong, a presentation that did not land, or a listing you did not win.

Our total liability for all claims relating to the service is capped at the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars. As there is nothing to pay today, that cap is one hundred US dollars.

This applies however a claim is framed — contract, negligence, or anything else — and even if we were warned the loss was possible.

You will defend and indemnify POG Snap against claims, damages and costs arising from your content, your use of the service, or your breach of these terms — including a claim that artwork you uploaded infringed somebody’s rights.

• If any part of these terms is unenforceable, the rest of them stand.
• Not enforcing something once does not mean giving it up.
• You cannot transfer this agreement without our consent. We can transfer it to whoever acquires the business.
• These terms and the privacy policy are the whole agreement about the service, and replace anything said before.
• Neither of us is the other’s partner, agent or employee.

We can change these terms, and the date at the top changes with them. If a change is material we will give notice by email or in the application before it takes effect. Carrying on using the service after that is acceptance; if you would rather not accept, stop using it and ask us to close the account.

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any suit goes in the state or federal courts sitting in Pennsylvania, and both of us consent to their jurisdiction. The UN Convention on Contracts for the International Sale of Goods does not apply.

Before filing anything, write to support@pogsnap.com and give us 30 days to put it right. Nearly everything gets solved that way, and it is a great deal cheaper for both of us.
